These terms apply to all visitors, enquirers, and clients of MKDA Digital, a sole trader (eenmanszaak) registered in The Hague, Netherlands.
MKDA Digital provides growth consulting services to small and medium-sized businesses. Services may include, but are not limited to: growth strategy and positioning, performance marketing (paid ads, email, CRM), copywriting and messaging, and AI-augmented execution.
The content on this website is for informational purposes only. Nothing on this site constitutes a binding offer. All engagements are formalised through a separate written agreement between MKDA Digital and the client.
The specific scope, deliverables, timelines, pricing, and payment terms for any consulting engagement are agreed in a separate Statement of Work or service agreement signed by both parties. These Terms of Service apply in addition to, and do not replace, any such agreement.
MKDA Digital reserves the right to decline any engagement at its sole discretion, including but not limited to cases where there is a conflict of interest, insufficient information provided, or where the work requested falls outside our scope of services.
All content on this website — including text, graphics, design, and code — is the property of MKDA Digital and is protected by applicable copyright and intellectual property law. You may not reproduce, distribute, or create derivative works without prior written permission.
Unless otherwise agreed in writing, intellectual property created by MKDA Digital during a client engagement remains the property of MKDA Digital until full payment has been received, at which point ownership transfers to the client as specified in the relevant agreement.
MKDA Digital treats all client information shared during enquiries and engagements as confidential. We will not share your business information, strategies, or data with third parties without your consent, except where required by law.
Likewise, clients agree to keep confidential any proprietary methodologies, processes, or tools shared by MKDA Digital during an engagement.
MKDA Digital provides consulting services based on experience and best professional judgment. However, we cannot guarantee specific business outcomes, revenue targets, or marketing results, as these depend on many factors outside our control.
To the maximum extent permitted by Dutch law, MKDA Digital's total liability arising out of or in connection with any engagement is limited to the fees paid by the client for the specific service giving rise to the claim during the preceding three months.
MKDA Digital is not liable for indirect, incidental, or consequential damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity.
These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from these terms or from any engagement with MKDA Digital shall be subject to the exclusive jurisdiction of the competent courts in The Hague, Netherlands.
Where applicable, EU consumer protection law and GDPR rights are not affected by these terms.
MKDA Digital reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of this website after changes are posted constitutes acceptance of the revised terms.
